About These Terms

“EndViolenceEverywhere.org,” “EVE,” “we,” “us,” or “our” means End Violence Everywhere, a U.S. 501(c)(3) and its Canadian charitable affiliate. “Services” means our websites, mobile applications, AI chatbot (“EVE AI”), and in-person advocacy programs. “You” means any user of the Services. These Terms govern your access to and use of the Services that link to or reference these Terms. By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

 

Changes to These Terms and to the Privacy Policy

We may update these Terms and our Privacy Policy. If we make material changes that affect how we collect, use, or share information, or that impact safety or confidentiality, we will provide prominent notice before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the changes.

 

Non-Governmental Affiliation: EVE is an independent nonprofit. We are not affiliated with any government agency.

 

Eligibility and Permission to Use

To access or use the Services, you must be 18 years or older and have the requisite power and authority to enter into these Terms. You may not access or use the Services if you are a competitor of EVE for the purpose of developing, training, or improving a competing product or service, or if we have previously banned you from the Services or closed your account. Web Crawling and Indexing. EVE permits public search and discovery of publicly accessible pages via automated crawling or indexing consistent with industry standards and any instructions we publish (e.g., robots.txt). Crawling or scraping that collects, republishes, or attempts to infer personal or safety-sensitive information about users or survivors is prohibited. Your use of the Services is at your own risk, including the risk that you might be exposed to content that is offensive, indecent, inaccurate, objectionable, or otherwise inappropriate.

EVE AI provides general informational content and is not a substitute for professional legal advice, medical care, or a human advocate. No attorney-client or physician-patient relationship is created. Prohibited Conduct and Restrictions on Use

You agree not to, and will not assist, encourage, or enable others to:
• Violate these Terms or any applicable law.
• Violate third-party rights, including copyrights, trademarks, patents, trade secrets, moral rights, privacy rights, and rights of publicity.
• Threaten, stalk, harm, or harass any person, or promote bigotry, discrimination, or violence.
• Engage in commercial use of the Services unrelated to EVE’s mission, including promoting a business or event, except where expressly authorized by EVE.
• Collect or attempt to collect any portion of content or data from the Services in a way that is unlawful, misleading, or contrary to these Terms, including harvesting or attempting to infer personal or safety-sensitive information about users or survivors.
• Send bulk or deceptive communications, including spam, surveys, or mass messaging; attempt to manipulate indexing or ranking systems in a deceptive manner; or interfere with the normal operation of the Services.
• Post, solicit, or facilitate fake, compensated, undisclosed, or deceptive reviews or ratings of EVE or EVE AI on third-party platforms (including Google Business Profile, Apple App Store, and Google Play), or otherwise attempt to manipulate rankings on those platforms.
• Misrepresent your identity, affiliation, or experience in any review, rating, complaint, takedown request, or public endorsement related to EVE or EVE AI.
• Modify, adapt, translate, create derivative works of, reproduce, distribute, publicly display, sell, trade, or exploit the Services or content (other than Your Content) except as expressly authorized by EVE.
• Access, query, or collect data using automated means (including bots, scrapers, or crawlers) to build, train, or improve a competing product or service, or after EVE has banned or restricted your access.

Public Search and Discovery. EVE permits good-faith crawling and indexing of publicly accessible pages for search and discovery consistent with industry standards and any instructions we publish (for example, robots.txt). This permission does not allow collection, republishing, or inference of personal or safety-sensitive information about users or survivors, and does not override any access restrictions or bans EVE may impose.

 

Suggestions and Improvements

By sending us ideas, suggestions, documents, or proposals (“Feedback”), you confirm that (i) you have the right to provide the Feedback and it does not include third-party confidential information; (ii) we have no confidentiality obligations regarding the Feedback; and (iii) you grant EVE an irrevocable, non-exclusive, worldwide, perpetual, royalty-free license to use, reproduce, modify, adapt, publish, create derivative works from, distribute, publicly display, and sublicense the Feedback without compensation to you. Do not include personal, sensitive, or safety-critical information in Feedback. If Feedback inadvertently contains such information, you may request deletion and EVE will reasonably accommodate where legally permissible and safe. You waive any moral rights you may have in the Feedback to the fullest extent permitted by law.

 

Third Party Websites

The Website may include links to other websites or applications (each, a "Third Party Website"). We do not control or endorse any Third Party Website. You agree that we are not responsible for the availability or contents of such Third Party Websites. Your use of Third Party Websites is at your own risk. We encourage you to read the privacy statements on all such sites as their policies may differ from ours.

 

Disclaimers and Limitations of Liability

No Professional Services. The Services (including EVE AI) provide general informational content and do not provide legal advice, medical care, mental-health treatment, or other professional services. No attorney-client or physician-patient relationship is created.

 

No Emergency Response. The Services are not an emergency service and may be unavailable, delayed, or inaccurate. If you are in danger or require urgent assistance, call 911 in the United States or 911/988 in Canada, or contact local emergency services.

 

Third-Party Platforms and Content. The Services may reference or link to third-party content, services, or providers (including shelters, legal aid, app stores, maps, and payment processors). We do not control or guarantee third-party offerings and are not responsible for them. Your use of third-party offerings is at your own risk.

 

User Content and Security. We do not guarantee that the Services or content will be accurate, complete, available, secure, free from harmful components, or error-free. You are responsible for taking appropriate precautions.

AS-IS / AS-AVAILABLE. The Services are provided “as is” and “as available” to the maximum extent permitted by law. EVE and its affiliates disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

 

Damages Exclusion. To the maximum extent permitted by law, EVE and its affiliates will not be liable for any indirect, special, incidental, punitive, exemplary, reliance, or consequential damages, or for lost profits, business interruption, reputational harm, or loss of information or data, even if advised of the possibility of such damages.

 

Liability Cap. EVE’s aggregate liability for claims arising out of or relating to the Services will not exceed the greater of (i) the amounts you paid to EVE for the Services in the twelve (12) months before the claim, or (ii) $100.

Exclusive Remedy. Your sole and exclusive remedy for dissatisfaction with the Services is to stop using the Services.

 

General Terms

We reserve the right to modify, update, or discontinue the Website at our sole discretion, at any time, for any or no reason, and without notice or liability. We may provide you with notices, including those regarding changes to the Terms by email, regular mail or communications through the Website. The Terms contain the entire agreement between you and us regarding the use of the Website, and supersede any prior agreement between you and us on such subject matter. The parties acknowledge that no reliance is placed on any representation made but not expressly contained in these Terms. Any failure on our part to exercise or enforce any right or provision of the Terms does not constitute a waiver of such right or provision. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder. If any provision of the Terms is found to be unenforceable or invalid, then only that provision shall be modified to reflect the parties' intention or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect and enforceable. The Terms, and any rights or obligations hereunder, are not assignable, transferable or sublicensable by you except with our prior written consent, but may be assigned or transferred by us without restriction. Any attempted assignment by you shall violate these Terms and be void.
