Intake Agreement

The following establishes the expectations, rights, responsibilities, and protections for both parties during the course of EVE’s in-person services and advocacy. 

 

1. Scope of Services 

EVE offers non-clinical, advocacy-based support, including but not limited to: 

● Safety planning

● Legal referrals and accompaniment 

● Housing navigation and emergency shelter access 

● Support groups and peer advocacy 

● Resource referrals (medical, mental health, financial) 

● Community-based healing initiatives 

EVE does not provide legal representation, legal advice or medical/clinical treatment.

 

2. Confidentiality and Information Protection 

EVE will maintain strict confidentiality regarding all survivor communications, files, and identifying information. This includes but is not limited to: 

● Full name, address, contact information 

● Survivor’s narrative, documentation and experiences 

● Family or dependent-related information 

Permissible Exceptions to Confidentiality: 

Information may be disclosed without survivor consent under the following legal obligations: 

● Mandated reporting: Suspected child or elder abuse, or abuse of a vulnerable person 

● Imminent risk: If the Survivor, their children, or another individual is at risk of serious harm 

● Court-ordered disclosure: In response to a valid subpoena or judicial order 

Survivors will be notified of any such disclosures to the extent permitted by law. 

EVE staff will: 

● Secure all physical and digital records in compliance with applicable privacy laws 

● Limit access to survivor information to only those directly involved in service provision 

● Maintain strict internal confidentiality even after services have concluded 

 

3. Survivor Rights 

The Survivor has the right to: 

● Be treated with dignity, empathy, and respect at all times 

● Determine which services to engage with and withdraw consent at any time 

● Access and review personal records upon request, within the limits of law and safety 

● Receive culturally responsible, inclusive, and trauma-informed care 

● File a grievance regarding services received without fear of retaliation 

 

4. Survivor Responsibilities 

The Survivor agrees to: 

● Participate in services voluntarily and communicate changes in needs or risk 

● Respect the confidentiality and safety of others accessing EVE services 

● Avoid behaviours that may endanger staff, volunteers, or peers 

● Use EVE services in good faith and not for purposes of surveillance, coercion, or litigation 

Failure to comply with these responsibilities may result in temporary suspension or termination of services to preserve organizational integrity and safety. 

 

5. Service Limitations and Disclaimer 

EVE will make every reasonable effort to provide high-quality, survivor-centred support. However, EVE cannot guarantee: 

● Legal outcomes or judicial decisions 

● Placement in housing or access to third-party resources 

● Resolution to systemic barriers or external service delays 

EVE advocates are lay people and do not provide legal advice, therapy or mental health services. All services are offered in good faith and are subject to availability and funding. For limitations specific to EVE AI, see the “Health, Legal, and Safety Disclaimer for EVE AI” above.

 

6. Documentation, Data Retention, and Recordkeeping 

All survivor records will be stored securely within EVE’s internal systems and shall: 

● Remain the property of EVE 

● Be retained for a minimum of seven (7) years following the termination of services, unless otherwise legally required 

● Be destroyed securely upon expiration of the retention period or in the event of EVE’s dissolution 

 

7. Agreement Duration and Termination 

The Agreement shall remain in effect: 

● Throughout the Survivor’s active involvement with EVE 

● Beyond the duration of services, as applicable to confidentiality and legal obligations 2

The Survivor may revoke consent to services or information sharing in writing at any time. Upon revocation, services will cease, and records will be retained per EVE policy. 

This Agreement may be terminated: 

● By mutual written consent of both parties 

● By EVE, with cause, in the event of breach, misuse, or safety concerns 

 

8. Acknowledgement and Consent 

By continuing to use our EVE resources, the Survivor affirms that: 

● They have read, understood, and agree to the terms outlined in this Agreement 

● All questions have been answered to their satisfaction 

● They are voluntarily engaging with EVE and consent to receive services as described
